Pennoyer pleads not guilty in heroin overdose

Jan. 29, 2014

Troy S. Pennoyer, 32, appeared in court today after being accused of supplying the heroin that killed 35-year-old David R. Teske of the Town of Eagle last November.

Pennoyer entered a plea of not guilty after the court decided he would be bound over for trial.

According to the criminal complaint, Teske was found facedown on his bedroom floor by his father. Resuscitation efforts failed and officers found items often used to inject heroin when they searched the home.

While initially adamant that they had only played frisbee, Pennoyer allegedly admitted that he knew a heroin dealer named "Rick" and said he might have provided Teske with the drugs, according to the complaint. Detectives believe the men would say they were playing frisbee golf as “disc golf” was a code word for heroin use.

Detective Ryan Dronek testified today, explaining that there were also several text messages on Pennoyer’s phone indicative of creating or following through with a drug transaction. Dronek also explained that they searched Pennoyer during questioning and allegedly found a paper bindle with a white substance inside of it, field testing positive as heroin.

Waukesha County Associate Medical Examiner Dr. Zelda Okia also testified in court, explaining that Teske had died from acute heroin intoxication.

Pennoyer is being charged in Waukesha County Circuit Court with first-degree reckless homicide, an offense that carries a maximum penalty of 40 years in prison and $100,000 in fines.
